Brown’s Health and Beauty Services – Terms and Conditions of Sale
Updated 27 October 2026
These terms apply to purchases of Health and Beauty services made through Brown’s online purchasing platform. The platform does not sell or supply medicines, prescriptions, pharmacy products, or other retail goods. Please read these terms together with the service description, any service-specific conditions shown before checkout, and Brown’s Privacy Notice.
1. Brown’s and applicable terms
1.1 The seller is Brown’s Pharma Limited, trading as Brown’s Pharmacy, of Brown’s Q3, Level 2, Unit 1, Quad Central, Triq L-Esploraturi, Central Business District, Mrieħel CBD 1020, Malta (“Brown’s”, “we”, “us” or “our”).
1.2 These terms apply when you buy a Health or Beauty service through the online purchasing platform identified by Brown’s. They do not govern purchases made in a Brown’s pharmacy or other transactions outside that platform, unless we expressly say otherwise.
1.3 The service description and any special conditions displayed for the service form part of your contract. If a special condition conflicts with these general terms, the special condition applies to that service only, subject always to your statutory rights.
2. Definitions
2.1 “Customer”, “you” and “your” mean the person purchasing or receiving the service, as applicable.
2.2 “Service” means a Health or Beauty treatment, treatment session, package, membership, or related service offer to be redeemed in one of the selected Brown’s Pharmacies.
2.3 “Order” means your online request to purchase a Service, and “Contract” means the agreement formed when we accept your Order.
2.4 “Practitioner” means the appropriately trained Brown’s employee or other authorised professional who assesses or provides the Service.
3. Orders and contract formation
3.1 Before placing an Order, check the service, treatment area, number of sessions, price, validity period, and any special conditions shown at checkout. You are responsible for entering accurate contact and purchase information. Each service is limited to the scope explained in the relevant service description before purchase.
3.2 By submitting an Order, you are purchasing the selected Service. We will send an automated acknowledgement when your Order is received. The Contract is formed when we confirm acceptance of the Order, normally by email or call by our customer care team.
3.3 An order confirmation or successful payment does not confirm that a treatment is suitable for you. Some Services require a consultation, test spot, medical information, or Practitioner approval before treatment can begin.
3.4 We may decline or cancel an Order if the Service is unavailable, the Order contains an obvious error, payment is not authorised, or we reasonably need to verify information. If we have taken payment for an Order we do not accept, we will arrange a refund using the original payment method, subject to applicable law.
4. Eligibility, consultation and suitability
4.1 You must be 18 or over to purchase a Service for yourself through the platform. A parent or legal guardian must contact Brown’s before arranging a Service for a person under 18; age restrictions and additional consent requirements may apply to particular treatments.
4.2 Some Services require a consultation, sample collection and, where specified, a test spot before treatment. Please attend these appointments and provide complete, accurate information. We may postpone or decline treatment/test if the Practitioner considers it unsuitable or unsafe, or if required information or consent is missing.
4.3 Before booking and before each service redemption, tell us about relevant medical or physical conditions, pregnancy, skin concerns, allergies, and any medication changes. Do not proceed with the service if you have been advised not to do so by a health professional or Brown’s Practitioner.
4.4 If a Service cannot be provided because it is unsuitable for you, contact us on customercare@brownspharmacy.eu. We will discuss any available alternative or refund due. Your statutory rights are not affected.
5. Prices and payment
5.1 The total price payable, including any applicable VAT, is shown before you place your Order. The price accepted for that Order will not change after the Contract is formed, except where the law permits or you agree to a change.
5.2 Payment must be completed through the payment methods offered at checkout. We may use a third-party payment provider to process your payment; that provider’s terms may also apply to its payment service.
5.3 Services bought online are paid for when the Order is placed unless the checkout states otherwise. Any additional charge agreed for an appointment must be paid before treatment begins. We may refuse or postpone treatment if a due payment has not been made.
5.4 A “membership” or “subscription” in a service name describes a treatment package and does not create recurring billing or automatic renewal unless the checkout clearly states otherwise. No automatic renewal is included in the offers covered by these Terms.
6. Your right to cancel an online purchase and refunds
6.1 If you are a consumer, you may have a statutory right to withdraw from an online service contract within 14 days after the Contract is formed. This right and any exceptions are governed by applicable consumer law and are not removed by these terms.
6.2 To withdraw, send us a clear statement within the applicable period using the contact details published on the platform or in your order confirmation. You do not have to use a particular form. We will confirm receipt.
6.3 If you ask us to begin providing a Service during the 14-day withdrawal period, we may require your express request before treatment starts. If you then withdraw after performance has begun, you may have to pay a proportionate amount for the Service already provided where the law allows. If the Service has been fully performed after your express consent and acknowledgement, the statutory withdrawal right may no longer apply.
6.4 Brown’s does not ordinarily offer a discretionary refund for a change of mind after the applicable cancellation period or after sessions have been used. This does not affect any statutory right to cancel, receive a refund or obtain another remedy, including where a Service is not provided with reasonable care and skill or does not conform to its description.
6.5 If you are advised for medical reasons to stop a course, contact us and provide supporting medical information if requested. We will review any unused sessions and explain any refund or other option available under the Contract and applicable law. Where a refund is given, any treatment already provided may be taken into account only as permitted by law and the applicable cancellation rules.
6.6 Unless the law requires otherwise, approved refunds will be made to the original payment method. Any refund will be processed within the period required by law.
7. Complaints
7.1 If you are unhappy with a consultation, appointment or treatment, please contact the clinic manager or Brown’s using the contact details in your order confirmation as soon as possible. Tell us what happened and how you would like us to help.
7.2 We will review your concern and respond within a reasonable time. Raising a complaint does not affect your statutory rights.
8. Personal data
8.1 Brown’s Pharma Limited is responsible for handling personal data collected through the platform and in connection with Services. We process personal data in accordance with our Privacy Notice and applicable data-protection law.
8.2 Some Services require us to collect health information. We will explain what information is needed, why it is used, who may receive it, how long it is kept, and the lawful basis that applies in the Privacy Notice and relevant consultation documents. Agreement to these Terms is not, by itself, consent to every use of health data.
8.3 Please refer to the Privacy Notice for information about your data-protection rights and how to contact Brown’s about a data request or concern.
8.4 Certain health tests require samples to be forwarded to an external laboratory for analysis. By proceeding with the test, you acknowledge that your sample and the personal and health information necessary to perform the analysis and report the results will be shared with the relevant laboratory, in accordance with Brown’s Privacy Notice. Results are subject to the laboratory’s processing times and sample suitability requirements.
9. Website use and intellectual property
9.1 The website content, service descriptions, branding, images and other materials are owned by Brown’s or used with permission. You may use them only to browse the platform and purchase Services for personal use.
9.2 You must not misuse the platform, attempt to disrupt its operation or security, submit false information, or use it in breach of law.
10. Liability
10.1 Nothing in these Terms limits or excludes liability where the law does not allow it, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
10.2 Subject to clause 10.1, Brown’s is responsible for loss or damage that was a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable or for loss caused by information you failed to disclose, where the law permits this limitation.
10.3 These Terms do not make you responsible for a risk that Brown’s is legally responsible for, and do not waive any right that cannot lawfully be waived.
11. Changes, events outside our control and legal terms
11.1 We may update these Terms for future Orders. The version in force when you place your Order applies to that Contract, unless a change is required by law or agreed with you.
11.2 If an event outside our reasonable control prevents or delays a Service, we will contact you and take reasonable steps to arrange a new appointment or other suitable solution. This clause does not remove your statutory rights.
11.3 If a court or competent authority finds part of these Terms unenforceable, the remaining provisions continue to apply to the extent permitted by law.
11.4 These Terms are governed by the laws of Malta. Consumers may also be entitled to bring proceedings in the courts available to them under applicable consumer law.
